Acceptance of Terms

By accessing or using VoxScreen ("Service"), operated by VoxScreen Inc. ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; continued use of the Service after changes constitutes acceptance of the revised Terms.

Description of Service

VoxScreen is a SaaS platform that enables recruiters and hiring teams to create AI-powered voice interview screenings. The Service includes tools for generating interview questions, inviting candidates, collecting asynchronous voice responses, AI-powered transcription and scoring, and candidate ranking.

Account Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. You must be at least 18 years old to create an account. One person or entity may not maintain more than one free account.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation, including employment discrimination laws.
• Collect voice data from candidates without proper disclosure and consent.
• Transmit spam, malicious code, or harassing content.
• Attempt to reverse-engineer, scrape, or circumvent any security measure of the Service.
• Impersonate another person or entity.
• Use the Service for any purpose other than legitimate hiring and recruitment activities.

You are solely responsible for ensuring your use of the Service complies with applicable employment and privacy laws in your jurisdiction, including providing appropriate notices to candidates about AI-assisted screening.

AI Processing & Voice Data

The Service uses third-party AI providers (including OpenAI) to transcribe candidate voice responses and generate scores. You acknowledge that: (a) AI-generated scores and summaries are tools to assist human decision-making and are not definitive assessments of candidates; (b) candidate voice recordings will be processed by our AI sub-processors as described in our Privacy Policy; (c) you are responsible for obtaining any legally required consent from candidates regarding AI-assisted screening; and (d) final hiring decisions must be made by humans and must comply with applicable equal opportunity employment laws.

Payments & Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We use Stripe for payment processing. By providing payment information, you authorize us to charge your payment method for applicable fees. We may change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.

Intellectual Property

The Service and its original content, features, and functionality are owned by VoxScreen Inc. and are protected by intellectual property laws. You retain ownership of content you create (job descriptions, interview questions you customize). By using the Service, you grant us a limited license to process and store your content solely for the purpose of providing the Service. You may not copy, modify, or distribute any part of the Service without our written permission.

Limitation of Liability

To the maximum extent permitted by applicable law, VoxScreen Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim. Some jurisdictions do not allow limitation of liability for certain damages, so these limitations may not apply to you.

Termination

You may terminate your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our data retention policy as described in our Privacy Policy.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
